Terms & Conditions

  1. Participant Age. All bidders must be 18 years of age or older, and provide identification as verification upon request.
  2. Terms and Conditions Binding. All bidders participating in this auction agree that they have read these terms and agree to be bound by and abide by these terms thereby.
  3. Payment. Payment must be made by cashiers' check, wire transfer or credit card and must be made prior to taking possession.
  4. Sales Tax. All sales will be subject to sales tax.
  5. No Charitable Contribution Deduction. Under IRS rules, no purchaser will be considered to have made a charitable contribution for any amount paid. No portion of the purchase price will be tax deductible.
  6. No Warranty. Vehicles are sold "as is" with no warranty. We have NOT inspected the vehicles, and make no claim as to the condition of any vehicles. The vehicles are have NOT been test driven; we cannot verify drivability or attest to the condition, or soundness of the vehicles, including but not limited to, the Powertrain, Drivetrain, Suspension, or Electrical Systems.
  7. No Refunds. THERE ARE NO REFUNDS.
  8. Assumption of Ownership. As the highest bidder, you are the buyer and are bound by the terms and conditions of this agreement and sale. The buyer assumes full responsibility for any vehicle purchased AT THE TIME IT IS SOLD, including the security of the vehicle. Each buyer must register purchased vehicle in his or her name as soon as possible after purchase.
  9. Binding Agreement. As a bidder, placing a bid is a binding agreement between you and Gator Boosters and the bid cannot be retracted once accepted.
  10. Governing Law, Venue. Bidder agrees that this agreement shall be governed by the laws of the state of Florida and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Alachua County, Florida. All bidders waive any right to a jury trial and hereby agree to a bench trial before a judge. This agreement shall be governed in all respects by the laws of the State of Florida. If for any reason, a court of competent jurisdiction finds any part of this agreement to be invalid or unenforceable, that part will be enforced to the maximum extent permissible to affect the original intent of this agreement. If a part is found to be invalid or unenforceable, the remainder of this agreement shall continue in full force and effect. Such invalid or unenforceable part will be deemed severable from the other parts here and will not affect the validity or enforceability of the remaining parts.
  11. Attorney Fees. Should any litigation or mediation be commenced between the parties to this agreement, concerning this agreement or the associated auction, the bidder agrees that the court shall award the prevailing party all reasonable costs and expenses, including reasonable attorney's fees.
  12. Release of Rights. Bidder irrevocably and unconditionally waives and releases his or her rights (if any) to recover from the University of Florida, the University of Florida Board of Trustees, Gator Boosters, the University Athletic Association, the University of Florida Foundation and any direct support organization (as defined in Section 1004.28 of the Florida Statutes) of the University of Florida, (collectively referred to hereinafter "UF"), and waives any right to any and all damages, losses, liabilities; cost or expenses and claims thereof, whether direct or indirect, known or unknown, foreseen or unforeseen, which may arrive from, or be related to, bodily injury, property damage, or from the sale. Under no circumstances shall UF be liable for any special, incidental, or consequential damage or lost profits that result from or are related to the sale.
